An Overview Guide to Michigan's Gun Laws

Whether it concerns individuals, businesses, or municipalities, the reach of firearm laws extends far beyond the commonly thought of criminal defense and personal ownership including: 

  • Employers navigating workplace policies.
  • Manufacturers ensuring compliance with industry standards.
  • Retailers managing regulatory challenges.

In order to address some of these concerns, members of our Firearm Regulation Law practice group will be featured in the September 2nd Wednesday session:

Corporate attorney Rob Hamor, municipal law attorney Courtney Agrusa and employment law attorney Cliff Hammond provide a multifaceted update on the latest in firearm laws from multiple legal areas including:

Municipalities and Red Flag Laws:

  • Courtney will delve into one of the Red Flag measures which authorizes civil courts to issue temporary Extreme Risk Protection Orders (ERPOs), which legally prevent persons deemed at risk of harming themselves or others from possessing or purchasing firearms.
    • She will talk about ERPOs including how they are filed, how they are enforced and what the legal consequences are for noncompliance.
  • How can an attorney help municipalities navigate the updated state and federal laws including gun registrations and pistol purchase permits?

Michigan's Firearm Acts:

  • Rob will briefly address some of the Public Acts that concern businesses including:
    • Storage when minors are on premises - owner can be charged with a misdemeanor if a child gets the firearm and engages in certain conduct.
    • Safe storage device costs - lowering costs of storage devices including gun safes, cases, lockboxes, etc. 
    • Background checks
  • How these laws impact anyone who is a stakeholder in the firearms industry as a manufacturer or retailer.

An Employer's Responsibilities:

  • Cliff will discuss some of the implications these laws have for employers in both the public and private sectors including:
    • Can employers regulate firearms within their workplaces without violating the Second Amendment?
    • What general types of policies can employers include in handbooks regarding firearms?
